Executive Order A Positive Direction For Transgender Students

Early in his administration, President Biden signaled a significant shift from the previous administration in enforcing the rights of transgender and LGBTQ students.  EO on Preventing and Combating Discrimination Based on Gender Identity or Sexual Orientation, issued on Jan. 20, 2021 states, “[a]ll persons should receive equal treatment under the law without regard to their gender identity or sexual orientation”, including that “[c]hildren should be able to learn without worrying about whether they will be denied access to the restroom, locker room, or school sports.”  The legal root of the order rests in the Civil Rights Act of 1964 and the case of Bostock v. Clayton County, in which the Supreme Court held that Title VII’s prohibition against “sex discrimination” includes discrimination based on sexual orientation and gender identity.
